Introduction
These Terms of Service (“Terms”) govern your access to and use of the MyFin platform, website, and related services (collectively, the “Service”) provided by Byteswop (“MyFin”, “we”, “us”, or “our”).
By creating an account or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old to use MyFin. By using the Service you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You are not prohibited from using the Service under any applicable law
- If registering on behalf of a company, you have the authority to bind that company to these Terms
Your account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete registration information
- Keep your password confidential and use a strong, unique password
- Enable two-factor authentication where possible
- Notify us immediately at enquiry@myfin-hub.com if you suspect unauthorised access
- Not share your account with others or allow others to access the Service using your credentials
We are not liable for any loss or damage arising from unauthorised access to your account resulting from your failure to comply with these obligations.
License & usage
Subject to your compliance with these Terms and timely payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
Self-hosted licenses
If you purchase a self-hosted license, additional terms apply:
- Your license permits one (1) running instance of the software unless your plan specifies otherwise
- You may not sublicense, resell, or offer the software as a hosted service to third parties
- Perpetual licenses entitle you to run the specific version purchased; future major versions require a new license or active subscription
- License keys are non-transferable and may not be shared
Enthusiast licenses
Enthusiast licenses are granted at our sole discretion in exchange for active participation in product testing and feedback. We reserve the right to revoke an Enthusiast license at any time if participation obligations are not met or these Terms are breached.
Payment & billing
Subscription fees are billed in advance on a monthly or annual basis depending on the plan you select. All prices are displayed in South African Rand (ZAR) unless otherwise stated.
- Renewals — subscriptions renew either automatically or manually depending on your payment method chosen during checkout at the end of each billing period. You will receive a reminder before renewal.
- Cancellation — you may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.
- Failed payments — if a payment fails, we will notify you and attempt to retry. After 7 days of non-payment your account may be suspended. After 30 days of non-payment your account may be terminated and data deleted.
- Price changes — we will provide at least 30 days' notice of any price change. Continued use after the effective date constitutes acceptance of the new pricing.
Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Transmit any material that is unlawful, harmful, fraudulent, or misleading
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or attempt to derive the source code of any proprietary software
- Use the Service to process data on behalf of third parties as a service bureau without our written consent
- Resell or sublicense your access to the Service
- Scrape, crawl, or extract data from the Service by automated means without our prior written permission
We reserve the right to investigate violations and take appropriate action, including suspension or termination of your account and reporting to law enforcement.
Intellectual property
The Service, including its software, design, trademarks, and content, is owned by Byteswop and protected by applicable intellectual property law. These Terms do not transfer any ownership rights to you.
You retain full ownership of all data you enter into the Service (“Customer Data”). You grant us a limited license to process Customer Data solely to provide and improve the Service. We will not access your Customer Data except as necessary to provide support, as required by law, or with your explicit consent.
Your data
We implement reasonable technical and organisational measures to protect your data. However, you are responsible for maintaining appropriate backups of your Data. We recommend using the built-in export feature regularly.
On termination of your account, we will retain your data for 30 days during which you may export it. After this period, your data will be permanently deleted from our systems, subject to our legal retention obligations as described in our Privacy Policy.
Availability
We aim to maintain at least 99.5% monthly uptime for the hosted Service, excluding scheduled maintenance. We will provide advance notice of planned downtime where possible. We do not guarantee that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
Limitation of liability
To the maximum extent permitted by applicable law:
- The Service is provided “as is” without warranties of any kind, whether express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability to you for any claim arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
MyFin is an accounting tool and does not constitute professional financial, tax, or legal advice. You remain solely responsible for your financial decisions and ensuring your compliance with applicable tax and accounting legislation.
Termination
You may terminate your account at any time via your profile page. We may suspend or terminate your access immediately and without notice if:
- You breach these Terms
- We are required to do so by law or a governmental authority
- We reasonably believe your account is being used fraudulently or in a manner that could harm us or others
On termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including payment obligations, intellectual property rights, disclaimers, and limitations of liability) will do so.
Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
